1- General principles
These General Terms and Conditions of Sale
(hereinafter referred to as the "GCS") apply to all sales made by COLLECTIF M or on its behalf. They apply to all orders received by COLLECTIF M or on its behalf from July1, 2020. The placing of an order implies unreserved acceptance of these GCS.
2- Distribution
The distribution, invoicing and collection of invoices for COLLECTIF M products are handled by COLLECTIF M, 15 rue Eugène Carrière, 75018 PARIS, registered in the Trade and Companies Register under number 814 039 483.
3- Controls
Orders must be sent to COLLECTIF M in accordance with the conditions described below.
4- Withdrawal
Pursuant to Articles L.221-5 et seq. of the French Consumer Code, the Customer has a period of 14 days from the date of delivery of the Order to return any new and unopened product, in its original packaging and in perfect condition (any product that is damaged, incomplete, or whose packaging has deteriorated will not be accepted), to request a refund without penalty.
In particular, COLLECTIF M will not reimburse products whose bags have been opened.
The Customer must therefore place the unopened package containing the product in a suitable package to which the return label will be affixed, before sending it by post. The Customer must also enclose a copy of the invoice or any other element that identifies the Order in question and its owner.
The return of the Product is carried out at the Customer's risk. If the package is lost, stolen or damaged when the Product is returned, COLLECTIF M reserves the right to refuse reimbursement of the returned Product(s).
Only the Customer identified as such to COLLECTIF M may exercise this right, to the exclusion of any other person, and in particular the recipient of the delivery. The return address is: 15 rue Eugène Carrière, 75018 PARIS.
5- Delivery costs and times
COLLECTIF M delivers in France, Belgium and England.
Delivery charges will be specified on the home page of the Site and during the Order process. They must be accepted by the Customer at the time of the Order validation.
In application of article L. 216-1 of the French Consumer Code, the Parties agree that the Products will be delivered within the timeframe specified during the Product Order process and prior to the validation of said Order. Delivery times are also specified in the Order confirmation e-mail sent to the Customer.
Delivery times include the preparation and dispatch of the Order, as well as the time it takes for the Products to reach the point of delivery (the Customer's postal address).
If the Site does not specify a delivery time for the Products, COLLECTIF M undertakes to deliver them within a maximum period of 30 (thirty) days from the date of the Order confirmation e-mail sent to the Customer by RESSOURCE Corps-Mental. In this case, the Products concerned will be delivered within the time indicated on the Site and reminded at the time of the Order.
However, since COLLECTIF M uses external service providers (postal services) to deliver the Products, COLLECTIF M is totally dependent on these third-party service providers. The delivery times indicated on the Site may therefore be affected by the service providers without COLLECTIF M being responsible for these delays in delivery and the consequences that may result from them. Any delays shall not entitle the purchaser to cancel the sale, to refuse the goods or to claim damages.
6- Reception - Compliance
In the event of missing product or transport damage, the recipient must make a claim via the contact e-mail on the ressourcecm.com site(contact@ressourcecm.com) or make all the usual reservations with the carrier.
Any reservations or disputes relating thereto must be noted on the delivery note with the carrier, and these reservations must be confirmed within three (3) days by extrajudicial document or registered letter with a copy to COLLECTIF M, which, if necessary, will take recourse against the carrier.
7- Awards
Our prices are in Euros.
All our orders are invoiced according to the price list in force at the time the order is placed.
Products are delivered carriage paid in mainland France from a minimum order of €35. For orders of less than €35 excluding VAT, a flat-rate charge of €6.90 excluding VAT will be invoiced.
Postage, local taxes and customs fees are charged for deliveries outside mainland France.
Prices are subject to the value-added tax applicable on the day of the order. Any change in the applicable VAT rate will be automatically reflected in the prices of products sold by COLLECTIF M. All orders are payable in Euros.
8- Regulations
Payment in cash. No discount for early payment will be applied.
In the event of total or partial non-payment of any invoice by the due date, COLLECTIF M will charge a late payment penalty on the outstanding amount, applying an interest rate equal to three (3) times the legal interest rate in force on the day the unpaid sums fall due. The fixed indemnity for collection costs, due by operation of law by any professional in a situation of late payment in the event that the sums due are paid after the agreed settlement date, is set at €40, in accordance with the terms of the applicable law.
9- Reservation of ownership
COLLECTIF M expressly reserves ownership of the goods delivered until payment in full, including any late payment penalties.
In the event of the purchaser's insolvency, receivership or liquidation, COLLECTIF M reserves the right to reclaim the goods wherever they may be.
The risk of theft, loss or deterioration of the Products shall be borne by the customer as soon as they are made available to him/her.
10- Force majeure
The performance of COLLECTIF M's obligations under the terms of these general terms of sale shall be suspended in full in the event of an event constituting force majeure. Any unforeseeable or irresistible event such as fire, flooding, strike, lock-out, or binding provisions of the administrative or health authorities shall be considered as force majeure.
11- Dispute
In case of dispute or litigation, only the Commercial Court of Paris is competent, except in the case of a contrary public order provision.
12- Guarantees
The products are sold as is and are deemed to comply with their technical specifications. Subject to any legal provision of public order, COLLECTIF M does not contract any obligation of result for its products, and its obligations are limited to the sale and delivery of products that comply with the characteristics and specifications of the products and with the requirements of the applicable standards in force, to the exclusion of any implementation, which remains the responsibility of the purchaser.
COLLECTIF M shall be released from all liability in the event of failure to comply with the conditions of use of the products: in the technical notices, packaging, instructions specified by COLLECTIF M or other related regulatory documentation and/or abnormal use of the products such as, but not limited to, failure to comply with storage conditions. In particular, the purchaser must ensure that his storage conditions are suitable for the proper preservation of the products and offer the safety guarantees imposed by the regulations in force. COLLECTIF M provides no guarantee in this respect.
COLLECTIF M's liability in its dealings with the purchaser, regardless of the grounds indicated, shall be limited solely to the direct loss suffered by the purchaser, to the exclusion of any consideration of any loss of profit, operating losses, exchange losses and more generally any indirect and/or immaterial loss or damage, whether consequential or not, including in particular those relating to the purchaser's image.
